1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of Tuckie (the "App", "Service"), operated by Billionants Technologies LLP ("we", "us", "our").

By downloading, installing, or using Tuckie, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

2. Description of the Service

Tuckie is a personal inventory management application that allows users to:

  • Catalogue and manage physical items they own
  • Organise items by location, category, and custom tags
  • Attach photos, notes, and metadata to inventory items
  • Sync their inventory securely across devices

3. Eligibility

To use Tuckie, you must:

  • Be at least 13 years of age (or 16 in jurisdictions where GDPR applies to minors)
  • Provide accurate information when creating an account
  • Have the legal capacity to enter into a binding agreement

By using the App, you represent and warrant that you meet all of the above requirements.

4. Account Registration

4.1 Creating an Account

You must create an account to use Tuckie. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain the security of your password and account credentials
  • Notify us immediately of any unauthorised access to your account
  • Take responsibility for all activities that occur under your account

4.2 Account Termination

We reserve the right to suspend or terminate your account at our discretion if you violate these Terms, without prior notice or liability.

5. Acceptable Use

5.1 Permitted Use

You may use Tuckie solely for your personal, non-commercial inventory management needs.

5.2 Prohibited Conduct

You agree not to:

  • Use the App for any unlawful or fraudulent purpose
  • Attempt to reverse engineer, decompile, or extract the source code of the App
  • Upload malicious code, viruses, or any harmful content
  • Use automated tools (bots, scrapers) to access or interact with the App
  • Attempt to gain unauthorised access to other users' accounts or data
  • Resell, sublicense, or commercially exploit the App or its content
  • Use the App in a way that could damage, disable, or impair its functionality

6. Subscriptions and Payments

6.1 Free Tier

Tuckie offers a free tier with limits on the number of items and photos you can upload. The specific limits of the free tier are detailed within the App.

6.2 Pro Tier (Tuckie Pro)

Premium features are available via a Tuckie Pro subscription, billed on a monthly or annual basis through the Google Play Store.

  • Subscription pricing will be displayed in the App before purchase
  • All payments are processed and managed by Google Play Billing
  • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period
  • You may cancel at any time via your Google Play account settings

6.3 Refunds

Refund requests are handled in accordance with Google Play's refund policy. We do not independently process refunds for purchases made through Google Play.

6.4 Price Changes

We reserve the right to change subscription pricing. We will provide reasonable advance notice of any price changes.

7. Intellectual Property

7.1 Our IP

The App, including its design, graphics, UI, and underlying code, is owned by Billionants Technologies LLP and is protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to use the App for personal purposes only.

7.2 Your Content

You retain full ownership of the data, photos, and content you upload to Tuckie (your inventory data). By using the App, you grant us a limited, non-exclusive licence to store and process your content solely for the purpose of providing the Service to you.

We do not claim ownership of your content and will not use it for any other purpose.

8. Privacy

Your use of Tuckie is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review it carefully to understand our data practices.

9. Disclaimers and Limitation of Liability

9.1 "As Is" Service

The App is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that:

  • The App will be uninterrupted, error-free, or free of harmful components
  • Any errors or defects will be corrected
  • The App will meet your specific requirements

9.2 Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for any:

  • Indirect, incidental, special, or consequential damages
  • Loss of data, profits, goodwill, or business interruption
  • Damages arising from your use or inability to use the App

Our total aggregate liability to you for any claims arising out of or relating to these Terms shall not exceed the amount you paid us (if any) in the 12 months prior to the event giving rise to the claim.

9.3 Data Loss

While we implement robust backup and security measures, you are responsible for maintaining your own backups of important inventory data. We are not liable for accidental data loss.

10. Indemnification

You agree to indemnify and hold harmless Billionants Technologies LLP, its officers, directors, and agents from any claims, damages, losses, or expenses (including legal fees) arising out of:

  • Your violation of these Terms
  • Your use or misuse of the App
  • Your violation of any third-party rights

11. Third-Party Services

The App may integrate with or link to third-party services (e.g., Google Play, Supabase). We are not responsible for the content, privacy practices, or terms of any third-party services. Your use of third-party services is governed by their own terms and policies.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will:

  • Update the "Last Updated" date at the top of this document
  • Notify you via an in-app notice or email (where applicable)

Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using the App.

13. Termination

13.1 By You

You may stop using Tuckie at any time and delete your account from within the App's settings. Upon account deletion, your data will be permanently removed within 30 days.

13.2 By Us

We may suspend or terminate your access to the App at any time, with or without cause, with or without notice. Upon termination, your right to use the App ceases immediately.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the App shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be subject to the exclusive jurisdiction of the courts of India.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Billionants Technologies LLP with respect to the use of Tuckie and supersede all prior agreements.
